Our services only cover residential financing and properties in the United States.  National Home Loan Advocates is not a lender, does not act as a credit provider, nor do we originate mortgage loans.  NHLA provides information on this website for general guidance only. The information we provide you in any form - written or verbal - does not constitute the provision of a mortgage originator, legal advice, tax advice, accounting services, or investment advice. The information provided herein should not be used as a substitute for consultation with a mortgage lender or professional tax, accounting, and legal advisors as needed. 

NHLA does not make mortgage loans or commitments and any information you give NHLA is not an application for credit.  NHLA is not acting as an agent for you in your efforts to obtain a mortgage loan.  Rather, it is a request for assistance by NHLA as a third-party or a request you have made to receive additional information from accredited lenders in our network.  We do not take residential mortgage applications, nor do we assist you in obtaining or applying for your residential mortgage loan.  We do not negotiate mortgage terms with lenders on the behalf of consumers.  You may have to complete an application with a lender before they will extend an unconditional loan offer to you.  At your request, NHLA will pass along the limited information you submit to us if you have elected to be contacted by a mortgage lender that has been accredited by NHLA and the lenders will contact you with additional information and offers.  NHLA does not distribute the products of these lenders and NHLA does not guarantee the lowest price or best terms available in the market.  If you select our consumer services we will assist you in better understanding the marketplace while you shop and negotiate your loan terms with lenders you have selected.  NHLA will not select a specific lender for you nor require you to use any specific lenders.  Lenders you select will provide the funds for your loan.  A lender you select may require you to pay an application or other fee to cover the costs of an appraisal, credit report or other items.  The lender you select will determine the amount of any such fee and should provide information to you regarding the details of those fees.  NHLA may enter into independent contractor agreements with lenders and collect a fee(s) from these lenders to access information you request to be forwarded to the accredited lenders within our network.

If you decided to pay NHLA as your non-lending consultant to help you understand the mortgage process, marketplace, and offers you are receiving, our feedback to you is based on the industry averages, standards, and our professional experience and knowledge. Our recommendations and guidance are "as is" relative to the market at that time.  The review and guidance we offer you is based on our opinions only and should be used strictly as a guide to help you understand the mortgage process better and negotiate your best loan terms.  Our advice and recommendations should not be considered a guarantee of what you will or will not be charged by lenders nor what you should or should not be charged. We can only recommend from our knowledge of the marketplace at that time, and information you give us, as to what could be considered fair and beneficial home loan terms.  NHLA cannot and does not guarantee acceptence into any particular loan program by any lender(s).  If you ask us to forward your limited information to an accredited lender within our network, you are not required to purchase additional products or services from NHLA or any person or entity suggested or recommended by NHLA.

Our Personal Home Loan Advocates™ are independent contractors for NHLA.  We certify their ability and qualifications to provide guidance to consumers on behalf of NHLA.  We also provide ongoing training and support such that a PHLA™ can provide optimal service in a dynamic market.  NHLA cannot be held vicariously liable for the tortious acts and omissions of the contractor. However, our contractors are bound by agreements to abide by all rules and policies set forth by NHLA. 

From time to time NHLA will refer or guide you to a third-party website.  We do this for the sole purpose of exposing you to the most current and pertinent information to best serve you.  The information is provided "as is," with no assurance or guarantee of completeness, accuracy, or timeliness of the information, and without warranty of any kind, express or implied, including but not limited to warranties of performance, merchantability, and fitness for a particular purpose.

How NHLA is compensated. (1) NHLA may collect a fee from lenders to administer their accreditation application and membership.  (2) NHLA may collect a fee from accredited lenders to advertise or list their general information (but never loan offers or terms) on our website.  (3) NHLA may collect a fee from accredited lenders for our professional consultant lender services.  (4) NHLA may collect a fee from a consumer who requests membership into NHLA.  (5) NHLA may collect a fee from a consumer who requests consultation time with us to better understand the mortgage marketplace, mortgage process, or offers they are receiving from lenders.  SINCE NHLA DOES NOT ORIGINATE LOANS OR ASSIST CONSUMERS IN RESIDENTIAL MORTGAGE APPLICATIONS OR COMMITMENTS, NHLA WILL NEVER COLLECT A FEE FROM A CONSUMER TO OBTAIN A CREDIT OFFER FROM A LENDER.  If a consumer pays NHLA, they are paying for independent consultative advice and information only.

When we reference that we will respond or deliver a report within 24 or 48 hours, these delivery time frames are during business days for NHLA, which are Monday through Friday.  Our 24/7 Customer Service line is serviced by NHLA agents during normal business hours of Monday through Friday, 9:00am to 5:00pm central time.  Outside of these hours and weekends, our Customer Service line is answered by our answering service and they will deliver your message to us for immediate action during normal NHLA business hours. 

We will collect your mortgage disclosures and documents during the process of delivering your service to you.  After you have closed your mortgage transaction and have completed your NHLA service, we discard of these documents in a secure way in accordance with our security and privacy policies.  We do not retain your documents beyond the transaction. 

Lender Subscription Services: Registering for a subscription with National Home Loan Advocates for the Rate Advisory Service, implies an ongoing subscription requiring you to pay for the subscription in the future on a continuing basis, without further consent, until You or National Home Loan Advocates cancel the subscription. You are obligated to pay the entire monthly fee for the month of cancelation regardless of when the termination was initiated during the month. At our discretion, a pro-rata refund of the unused portion of a month may be granted. After receipt of a cancelation notice, NHLA will promptly process any refund due.  You may cancel Your Rate Advisory or Accreditation subscription at any time and NHLA may terminate, or change alter it at any time. All cancelations shall be effective immediately upon receipt of notice.

Lender Lead Services: This Service Agreement constitutes a Legal and Binding Contract between both parties and is being executed by authorized personnel of both parties. No verbal understandings have any part of this Service Agreement. NHLA does not guarantee any such pattern or schedule of lead disbursement. NHLA does not have control if lead applicant has applied elsewhere. If any action at law or in equity is necessary to enforce or interpret the terms of this Agreement, the prevailing party shall be entitled to its actual attorneys' fees and costs.  All disputes must be settled in Dallas, Texas.

Purchaser agrees to employ due care and attention in handing the Leads.  Purchaser agrees to use its name and not that of NHLA in pursuing the Leads and/or contacting any Lead.  Purchaser acknowledges that it is not permitted under the terms of this agreement to re-sell leads purchased from NHLA. Purchaser represents and warrants to NHLA that Purchaser will not:  (i) violate any federal, state, local or foreign law or regulation including, but not limited to, the Gramm-Leach-Bliley Act, the FTC Act, the Truth in Lending Act and the Real Estate Settlement Procedures Act; (ii) infringe upon or misappropriate any copyright, trademark, patent, trade secret or other intellectual property right or other right, including any individual privacy right of any person or consumer.  Purchaser agrees to indemnify, defend (including immediate reimbursement of attorneys' fees) and hold harmless NHLA, its officers, directors, employees and agents, from and against any claims, actions or demands arising from or related to the breach of the warranties in this paragraph or other breach of this Agreement.

Independent Contractor.  NHLA s offering and selling its services per this arm's length Agreement as an independent contractor as defined under Texas law.  As such, the parties recognize that NHLA will not incur any liability as a result of Purchaser's actions.  NHLA shall not exercise control over Purchaser.  Further, in no event shall NHLA or its officers, directors, employees and agents be liable, whether in contract, tort or otherwise, for any indirect incidental or consequential damages (including without limitation, lost sales or profit, lost data, or business interruption).

Lead Guarantee & Replacement Policy.  Leads are replaceable ONLY if submitted within 3 business days and ONLY if the following apply:

a. Both home and work phone numbers are incorrect
b. Contact name is incorrect
c. Applicant/spouse did not fill out form
* Returned leads may be randomly verified.
* No assumptive or verbal understandings are a part of this agreement.
* No returns will be granted for purchases of aged leads over three days old.

Privacy Statement.  Purchaser represents and warrants that Purchaser, its agents and contracting partners (including but not limited to entities from which Leads are sold by Purchaser for resale to other third parties) utilize a lawful privacy disclosure policy statement in connection with the solicitation, receipt and use of any information from any person in connection with Leads.  Purchaser agrees to provide a copy of all applicable privacy statements, including those on the Internet, to NHLA for review and comment.

No Representations.  Wisdom has not made and does not hereby make any representations, guarantees or warranties whatsoever.

Limitation of Liability.  NHLA is not an agent, joint venturer, partner, representative, employee or affiliate of Purchaser.  As such, the parties recognize that Wisdom will not incur any liability as a result of Purchaser's actions or omission.

Non-disclosure.  The parties agree that both terms and the nature of this Agreement, including without limitation the identity of the parties, shall remain confidential and shall not be disclosed to any third party under any circumstances unless required by a court of law.

The invalidity or unenforceability or any one or more of the particular provisions of this Agreement, none of which are known to the parties, shall not affect the enforceability of the other provisions herein.

Additionally, the materials in this site and the third-party sites are provided “as is” and without warranties of any kind either express or implied. NHLA does not warrant that the functions contained in the materials will be uninterrupted or error-free, that defects will be corrected, or that this site or the server that makes it available, are free of viruses or other harmful components.

Email Delivery. Due to the nature of spam filter programs and ISP level email filtering, NHLA is unable to guarantee that emails sent from NHLA servers will be received. NHLA is not responsible for emails sent by NHLA that do not make it to the receivers email account.

YOU ACKNOWLEDGE THAT YOU HAVE READ THIS DISCLAIMER, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS INDEMNIFICATIONS, TERMS, AND CONDITIONS. YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND NATIONAL HOME LOAN ADVOCATES, WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATION BETWEEN YOU, NHLA, OR OUR INDEPEPENDANT AGENTS RELATING TO THE SUBJECT OF THIS DISCLAIMER AGREEMENT.  PLEASE PRINT THIS INFORMATION AND SAVE IT FOR YOUR RECORDS.
